UK Bans End-to-End Encryption, Mandates Government Authority Over Encrypted Technologies

The United Kingdom has legislated an effective ban on end-to-end encryption, giving the government a mandate to access backdoors in any technology they deem necessary.

Passed under Section 217 of the Investigatory Powers Bill, the provision provides the Secretary of State with the power to issue a “technical capability notice” to telecommunications operators, establishing a series of obligations:

“(1) The Secretary of State may give a relevant operator a notice (a “technical

capability notice”) —

imposing on the relevant operator any applicable obligations specified in the notice, and

requiring the person to take all the steps specified in the notice for the purpose of complying with those obligations.”

One of these obligations, found under (4)(c), pertains to the removal of “electronic protection” when requested:

“(c) obligations relating to the removal by a relevant operator of electronic protection applied by or on behalf of that operator to any communications or data;”

This means that, when requested by a telecommunications company, encryptions must be removed to provide government agents with access to any communication desired.

This indicates an obligation to maintain the ability to allow backdoor access for law enforcement into encrypted devices and services, effectively ending the legal use of end-to-end encryption.

This article reminds my that in times past (and perhaps to some degree today still) the US Government categorized encryption technology as weapons-grade munitions and this designation made it illegal to export.

If anything the UK is worse, GCHQ might be more subtle than the NSA but I doubt they're any more limited in their practises, just better at getting away with it. And cameras... omg. Fly into Heathrow, travel to Edinburgh and fly out and you're on camera ever for every single part of the journey unless you stick to minor roads and even then you'd show up in any towns on the way. Someday taxpayers might start asking how much this is costing them and what benefits it offers in return but I'm not holding my breath, just charge it to the government credit card and we'll worry about the bill later :/

I can't see a ban on end to end encryption ever working but I wouldn't put it past some state official to attempt entirely blocking users internet access and only allowing through approved connections, once upon a time a town on the south coast found a monkey on the beach and tried and hanged it because someone in charge thought it was a Frenchman so anything is possible. Might even get away with it too, short terms in office means the meshnets and wireless connections to a less draconian mainland Europe might be someone else's problem to deal with.

They might use this "encryption" card just to get someone guilty. Ridiculous. If someone sends a file and it gets damaged, and they spot it... "Yeah, we can't decide what is this file, therefore it has to be encrypted. Give us keys or you're using unauthorized encryption!"

The bill doesn’t explicitly ban encryption the government has introduced legislation that would ban companies like Apple from offering end-to-end encryption. What makes this particularly ironic is the discovery of other documents from earlier this year that show the UK encouraging enterprise and governments to adopt encryption.

Both the BBC and the Telegraph have sounded off about the new powers the government is seeking. According to the BBC, the new law (the Investigatory Powers Bill) would give government investigators “to see if someone used Snapchat at 07:30 GMT on their smartphone at home and then two hours later looked at Twitter’s website via their laptop at work, but neither the text typed into the app, nor the specific pages looked at on the social network would be accessible.”

That kind of power isn’t what has privacy advocates and security researchers worried, however. the IPB also requires that companies must take “reasonable” steps to provide data when a warrant is issued, even if that warrant applies to encrypted communication. Companies like Apple literally can’t take “reasonable” steps to provide law enforcement with information because they no longer have the ability to peer into their own encrypted devices without user-provided information.

While the bill doesn’t explicitly ban encryption, there’s been enormous concern about how things will play out if the government demands access to material that Apple, Google, or another manufacturer literally can’t provide.

A Home Office spokesperson speaking to the Telegraph said this:

The Government is clear we need to find a way to work with industry as technology develops to ensure that, with clear oversight and a robust legal framework, the police and intelligence agencies can access the content of communications of terrorists and criminals in order to resolve police investigations and prevent criminal acts. That means ensuring that companies themselves can access the content of communications on their networks when presented with a warrant, as many of them already do for their own business purposes, for example to target advertising. These companies’ reputations rest on their ability to protect their users’ data.” (Emphasis added).

Apple’s own encryption system can’t be made compliant with the new law without changes, which is why so many companies have been against these types of laws in the first place. Implementing encryption methods with backdoor decryption only weakens the entire stack. There’s no way to create vulnerabilities that are guaranteed to remain in the hands of the white hats, no matter who those white hats happen to be.

ISPs will be forced to retain this data for one year, including the aforementioned data on browsing activities.
